Terms of Service (Public Offer)

1. General

These Terms are a public offer by Aleksandr Novikov, the developer of the SonoForm service (the Developer), to conclude an agreement on access to the SonoForm software service available at getsonoform.com (the Service) on the terms set out below. The agreement is concluded when you accept the offer: acceptance is signing in to the account with your e-mail address (opening the sign-in link or entering the code from the message). The fact, date and time of acceptance and the edition of the Terms are recorded in the Service log.

The Developer may change the Terms, prices and functionality of the Service. A new edition is published at getsonoform.com at least 5 days before it takes effect, and existing users are notified by e-mail. Changes do not apply to processing already completed and to payments made before the change. A user who does not agree with the new edition may stop using the Service and receive a refund of the unused balance.

2. Subject

The Developer grants the User (an ultrasound physician or another specialist) a limited, revocable, non-transferable right to use the Service as a technical tool for preparing medical documentation: the Service recognises the dictated speech, places the dictated values into the fields of the examination report, performs arithmetic calculations by published formulas and produces documents in Word and PDF formats.

The Service is a documentation assistant and does not perform the functions of a medical device: it does not interpret images or measurements, does not assess whether values are normal and does not produce diagnostic conclusions. All values, calculations and the text of the impression are checked and confirmed by the User, who is responsible for the content of the report as its author.

The Developer keeps the Service operational subject to section 6 but does not guarantee error-free speech recognition and parsing of values: the result depends on the quality of the recording and is subject to the User's review.

3. Patient data

The Service is not intended for data that identifies a patient. There are no fields for the patient's name, date of birth or medical record number, and a warning is shown before a recording is uploaded. The User undertakes not to dictate or enter such data into the Service. Identifying details are added to the document by the User outside the Service.

4. User's responsibilities

The User is responsible for the content of the dictation, for checking the values, calculations and impression in the report, for the lawful use of the Service in their practice, for compliance with the requirements for medical documentation and personal data applicable to them, and for the security of their sign-in e-mail and linked devices. Actions performed through the User's account are deemed performed by the User unless the User has informed the Developer that the account was compromised.

The User undertakes not to use the Service for actions that violate applicable law or the rights of third parties, and not to attempt to disrupt the operation of the Service.

5. Developer's responsibility

The Developer is responsible for providing the service of proper quality: receiving the recording, processing it and providing the documents in the account. If processing fails through the fault of the Service, nothing is charged and the reserved amount is returned to the balance. If the service was not provided or was provided with defects, the User may request free re-processing or a refund of the cost of that processing.

The Developer is not responsible for the consequences of medical decisions made on the basis of documents whose content the User has confirmed, for the unavailability of the User's networks and equipment, or for losses caused by the User's breach of sections 3 and 4. The limitations of this section do not apply where the law does not allow liability to be limited, including mandatory consumer rights in the User's country.

6. Availability

The Developer aims to keep the Service available around the clock. Planned maintenance is performed mainly at night (UTC); maintenance longer than 2 hours is announced on the site in advance. Paid processing that could not be performed because the Service was unavailable is not charged.

7. Fees and payment

The Service is provided on a prepaid basis. The User tops up the account balance by an amount of their choice; the cost of each processed recording is deducted from the balance in proportion to the dictation length at the per-minute price published on the site, rounded up to 30 seconds, with a minimum charge of one minute. Repeated parsing of the text and rebuilding of documents within the published limits are free of charge.

If the balance is positive when processing starts, the processing is completed in full even if its cost exceeds the remaining balance; the resulting debt is settled with the next top-up, and no new processing is started until then.

Prices are published on the site in US dollars, and the balance is kept in US dollars: a top-up is credited in the amount paid, and processing is charged at the published per-minute price. Refunds are made in US dollars in the amount of the unrefunded remainder of the respective payment.

On registration the Developer grants free minutes to try the Service. Bonus minutes may also be granted for top-up packages. Free and bonus minutes are not money, are not refundable and are not paid out.

Payments are processed by the payment platform lava.top on its own pages; card details are not transferred to the Service. The procedure for payment and refunds is described in the Payment and Refund Rules, which form part of these Terms.

8. Suspension and termination

The Developer may suspend or terminate the User's access in case of a breach of these Terms, actions that threaten the security of the Service, or on justified requests of competent authorities, notifying the User by e-mail with the reason. The User may withdraw from the agreement at any time: delete the records in the account and send a request to delete the account and refund the balance to the support address. The unused balance is then refunded in the manner set out in the Payment and Refund Rules.

9. Other terms

The relationship between the parties is governed by the law of the country where the Developer is located, without prejudice to mandatory consumer protection rules of the User's country. Claims are sent to support@getsonoform.com; the response period is 10 calendar days. The parties will try to settle any dispute by negotiation before going to court.
